I am undergoing through the issue of refund of Rental bond from my landlord/agent. It happened because that some very slight burn mark is caused by us in the kitchen benchtop.
Now the kitchen benchtop is built in L shape and the minor section has the burn mark and the other portion of the benchtop has very minor scratches which could be considered as fair wear and tear. Even the smaller section is also completely usable and they have got a tenant who is starting from this Saturday.
Now the owner is making a big issue of this and are likely to ask us to get the entire benchtop replaced. They have held our bond which is not released from the last 12 days since we handed over our keys.
I think this is not fair in their part and even from the final inspection photos they have provided no mark could be proven in the major section of the benchtop.
We also know that replacing a laminated benchtop could be a very expensive process and it could also mean us we ending up spending more than the bond amount which is around $2500.
We are thinking to forward my case to Fair Trading NSW and then demand for my claim. My question is that has anybody already undergone such situation or know similar kind of situation?
Is this worth trying to get my bond money back? How much time it might take,
What are the chances to win such cases?
Any answer or suggestion from anyone is very helpful.
